Saint Francis Challenge New Mexico Volunteer Release and Waiver

This form is only for adults (18 years and older) serving in an unpaid volunteer capacity in New Mexico.

IMPORTANT NOTICE: BY SIGNING, YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CLAIMS FOR INJURY, ILLNESS, DEATH, OR PROPERTY LOSS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE FULLEST EXTENT NEW MEXICO LAW ALLOWS. READ THIS ENTIRE AGREEMENT BEFORE SIGNING.

I want to take part in unpaid volunteer activities organized, authorized, or supervised by Saint Francis Challenge. In exchange for being allowed to volunteer, I freely and voluntarily agree to the following terms.

1. Volunteer Activities

In this agreement, Activities means unpaid volunteer work organized, authorized, or supervised by one or more Released Parties in Santa Fe or elsewhere in New Mexico. Activities may include community outreach and engagement; surveys or research support; meetings, trainings, public events, and fundraisers; food preparation or service; sorting, loading, unloading, or distributing supplies; setup and cleanup; litter removal, landscaping, maintenance, or light construction; office, technology, or administrative work; and travel as a passenger between authorized locations. Activities may occur at shelters, housing sites, service programs, public property, private property, outdoor locations, streets, vehicles, offices, or event sites.

This agreement does not authorize me to drive on behalf of SFC or transport another person; perform skilled construction, electrical, plumbing, clinical, medical, or behavioral-health services; operate specialized equipment; or perform any task outside my assigned role. Those activities require separate written authorization, qualifications, and any additional agreement required by SFC or a host site.

2. Voluntary Personal Transportation and Carpooling

I may choose, but am not required, to drive my own personal vehicle, accept an informal ride from, or offer an informal ride to another adult SFC volunteer or adult participant when SFC and host-site rules permit. Any such personal carpool is voluntary and undertaken at my own risk. Unless SFC separately confirms otherwise in writing, an informal carpool is not transportation provided, assigned, directed, controlled, or guaranteed by SFC or another Released Party.

If I drive, I am responsible for maintaining a valid driver's license, legally required vehicle registration and automobile insurance, a safely maintained vehicle, compliance with traffic laws, use of required safety restraints, and safe operation. If I ride as a passenger, I am responsible for deciding whether to accept the ride and for using an available safety restraint. I understand that travel can involve collisions, vehicle failure, traffic, road and weather conditions, roadside hazards, bodily injury, death, and property damage. To the fullest extent permitted by law, I assume those risks, and the release in Section 7 applies to claims I may have arising from personal travel connected with the Activities. Transportation assigned, required, scheduled, reimbursed, or coordinated by SFC or another Released Party requires prior written driver authorization and compliance with any screening, license, insurance, vehicle, and documentation requirements imposed by SFC, a host site, or an insurer.

3. Released Parties

Released Parties means Players Philanthropy Fund, Inc. (PPF), including its fiscally sponsored project Saint Francis Challenge (SFC); the City of Santa Fe, New Mexico, including its departments, boards, commissions, and governing body; and every shelter provider, housing provider, service provider, volunteer organization, host site, co-sponsor, property owner, property operator, lessor, vendor, or other public or private partner that organizes, authorizes, hosts, supervises, supports, or provides a location for the Activities. It also includes each of those entities' present and former trustees, directors, officers, elected and appointed officials, employees, agents, volunteers, contractors, insurers, successors, and assigns, but only to the extent a claim relates to the Activities. Each Released Party is an intended third-party beneficiary of this agreement and may enforce it.

4. Volunteer Status

I am signing only as an unpaid volunteer. I am not signing as a resident, shelter or housing participant, client, service recipient, SFC program participant, Resident Steward participant, paid worker, employee, independent contractor, or agent. I do not expect wages, employee benefits, or authority to bind any Released Party. Reimbursement of a preapproved expense does not by itself change this understanding. Unless required by law or expressly confirmed in writing, no Released Party has promised me workers' compensation, medical, health, disability, automobile, or property insurance. Nothing in this agreement changes any status or coverage that applicable law requires.

5. Risks of Volunteering

I understand that the Activities can involve known and unknown risks, including conditions that may not be immediately apparent. Depending on the assignment, risks may include:

• slips, trips, falls, uneven ground, stairs, poor lighting, damaged surfaces, or unsafe property conditions;

• lifting, carrying, pushing, pulling, repetitive movement, physical exertion, fatigue, dehydration, or heat, cold, sun, wind, rain, snow, or other weather exposure;

• tools, equipment, vehicles, traffic, loading areas, sharp objects, broken glass, nails, debris, discarded needles, cleaning products, dust, fumes, noise, fire, electricity, or equipment failure;

• food preparation, hot surfaces, knives, allergens, foodborne illness, or contact with bodily fluids, pests, insects, or animals;

• communicable illness or exposure to unsanitary conditions;

• interaction with members of the public, residents, clients, or other persons whose behavior may be unpredictable, including verbal conflict, threats, harassment, or physical contact;

• theft, loss, or damage to personal property; transportation or roadside risks; delayed emergency response; emotional stress; and

• serious bodily injury, illness, disability, property damage, or death.

These risks may result from my own acts or omissions; the acts or omissions of a Released Party, another volunteer, a resident, a client, a member of the public, or another person; the condition of property or equipment; or the ordinary negligence of a Released Party.

6. Safety Responsibilities

I will perform only assigned tasks, follow training and site rules, use required protective equipment, stay within my abilities and qualifications, and promptly report unsafe conditions, injuries, threats, or incidents. I may decline or stop a task that I reasonably believe is unsafe and ask for another assignment. I will not volunteer while impaired by alcohol, illegal drugs, or any condition that makes the assigned task unsafe. I may request a reasonable modification without disclosing unnecessary medical information. I understand that this agreement is not a substitute for activity-specific safety instructions.

7. Assumption of Risk

Knowing the nature of the Activities and the risks described above, I voluntarily choose to participate. To the fullest extent New Mexico law allows, I knowingly assume the risks inherent in and reasonably related to the Activities, including risks arising from the ordinary negligence of a Released Party.

8. Release and Waiver of Claims Including Ordinary Negligence

For myself and my heirs, estate, personal representatives, and assigns, I release and forever discharge the Released Parties from every claim, demand, cause of action, damage, loss, cost, or liability arising out of or relating to my participation in the Activities, including travel connected with the Activities and emergency assistance. This release includes claims for bodily injury, illness, emotional distress, death, or damage to or loss of property that are caused in whole or in part by a Released Party's ordinary negligence, including negligent selection, training, instruction, supervision, maintenance, premises conditions, equipment, transportation arrangements, or first aid. I understand that I am giving up the right to sue a Released Party for its ordinary negligence, to the fullest extent New Mexico law permits.

This agreement does not release any claim that applicable law does not allow a person to release. It also does not limit any right or benefit that cannot lawfully be waived.

9. Covenant Not to Sue

I agree not to file, maintain, or voluntarily assist a lawsuit or other claim against a Released Party based on a claim I have released in this agreement. This sentence does not prevent me from reporting an incident, communicating truthfully with a government agency, responding to legal process, or pursuing a claim that cannot legally be waived.

10. Emergency Care and Costs

If I am injured or become ill and cannot make a timely decision, I authorize a Released Party to call 911, provide reasonable first aid, or arrange transportation for emergency care. No Released Party is required to provide medical care. I am responsible for medical and transportation costs not covered by insurance or another source. The release in Section 7 applies to ordinary negligence in arranging or providing emergency assistance to the fullest extent permitted by law.

11. Personal Property

I am responsible for safeguarding my belongings and will bring only items reasonably needed for the assignment. The release in Section 7 applies to loss, theft, or damage to my property to the fullest extent permitted by law.

12. Duration

This agreement applies to Activities I undertake during the 12 months after I sign it, unless SFC requires a new agreement sooner because my role, the risks, the participating organizations, or the agreement changes. A new agreement controls prospectively from the date it is signed.

13. New Mexico Law and Other Legal Terms

New Mexico law governs this agreement. Any legal action concerning it must be brought in a court with jurisdiction in Santa Fe County, New Mexico, or in the United States District Court for the District of New Mexico, unless applicable law requires another forum. Nothing in this agreement waives, limits, or impairs any governmental immunity, defense, damage limitation, notice requirement, or other protection available to a Released Party, including protections available to the City of Santa Fe under the New Mexico Tort Claims Act.

If a provision is invalid or unenforceable, it will be enforced to the maximum extent allowed or, if it cannot be narrowed, severed without affecting the remaining provisions. This agreement contains the entire understanding about the release and assumption of risk for the Activities. Written event or site safety rules supplement this agreement but do not expand the release beyond what the law allows. No oral statement changes this agreement.

14 Electronic Agreement and Signature

I agree to conduct this transaction electronically. My required acknowledgments, typed full legal name, and submission of this form together are my electronic signature, made with the intent to sign and be bound. I understand that SFC will retain an electronic record. I may request a paper form or a copy of the signed record by contacting SFC before or after submission.
